RE: The tariff classification of Fingolimod (CAS-162359-55-9), imported in bulk form, from Taiwan
Dear Ms. Forstenzer:
In your letter dated September 10, 2012, you requested a tariff classification ruling.
The subject product, Fingolimod, is a sphingosine-1-phosphate receptor modulator. It is indicated to reduce the rate of relapses and delay disability progression in patients with relapsing forms of Multiple Sclerosis (MS).
The applicable subheading for the Fingolimod imported in bulk form will be 2922.19.0900, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Oxygen-function amino-compounds: Amino-alcohols, other than those containing more than one kind of oxygen function, their ethers and esters; salts thereof: Other: Aromatic: Drugs.” Pursuant to General Note 13, HTSUS, the rate of duty will be free.
